Under the general direction of the Assistant Chief Counsel, the Attorney III works as an adept legal counselor to provide client-centered advice and assistance on a broad range of legal issues involving or affecting HCAI operations. As part of a small legal office team, the Attorney III advises and represents HCAI in various forums, including public meetings, administrative proceedings, depositions, contract and settlement negotiations, interagency meetings, hearings, and other venues. Requiring minimal supervision, the Attorney III exercises broad discretion while working both collaboratively and independently as needed.
The Attorney III must have knowledge of the general legal provisions under which HCAI programs, boards and commissions operate, including an understanding of the Administrative Procedure Act, the Information Practices Act, the Bagley-Keene Open Meeting Act, and the California Public Records Act. Essential knowledge and experience also include State contracting, conflict of interest, civil service, and personnel issues.
This position is subject to the Form 700 Statement of Economic Interests filing requirements, which requires disclosure of certain personal economic interests as determined by the Conflict of Interest Code of the Department of Health Care Access and Information. Pursuant to Government Code section 81008, Form 700 Statement of Economic Interests is public record and will be made available for public inspection.

Working Conditions
HCAI offers a hybrid telework schedule with a combination of remote and in-office work schedules for CA residents only. The telework policy is subject to change, and additional in-office days may be required and/or minimal notification may be given to report to the worksite if an urgent need arises.
Telework schedules: The expectation is that all staff will work in office 4 days a week July 1, 2026.

Desirable Qualifications
In addition to evaluating each candidate’s relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
- Experience with health care law
- Experience performing complex legal research and analysis
- Experience with Information Practices Act, HIPPA Privacy Rule, and/or data sharing agreements
- Experience analyzing pending legislation
- Experience interpreting or drafting regulations
- Experience reviewing and analyzing contracts, including government or IT contracts Experience with progressive discipline actions
- Experience with litigation
- Experience with Administrative Hearings

All Attorney Levels
All classifications require active membership in The California State Bar. (Applicants who are not members of The California State Bar but who are eligible to take the California State Bar examination or are in their final year of law school will be admitted to the examination but will not be considered eligible for appointment until they are admitted to The State Bar.)
Applicants who are six months from meeting the required legal experience will be admitted to the examination, but must meet the total required years of experience prior to appointment.
Attorney III
Five years of legal experience in the practice of law*.
* “Legal experience in the practice of law” is defined as: (1) only that legal experience acquired after admission to any State Bar, or (2) experience as a judicial clerk for a federal court, California’s state courts, or any other state’s courts, or (3) legal experience acquired while practicing under a provisional license to practice law issued by the State Bar of California’s Provisional Licensure Program, to constitute experience in the practice of law. For an individual’s judicial clerkship to qualify as “legal experience in the practice of law,” the experience must have been gained after receipt of a Juris Doctor or equivalent degree.
