Full-Time Risk Management Counsel
Job Description
Thompson Coburn, a large full-service law firm with offices in seven (7) cities across the U.S., is looking for a Risk Management Counsel to fill a full-time exempt position in any of its office locations in St. Louis, Chicago, New York City, Los Angeles or Washington, D.C. The Risk Management Counsel will provide guidance to Firm attorneys and staff on risk management and loss prevention issues with particular emphasis on the client-intake process, compliance with applicable Rules of Professional Conduct, conflicts checking procedure best practices, and identifying and resolving potential conflicts of interest for new clients and matters. The candidate selected for this position must have excellent organization and time management skills and must be accustomed to working in a fast-paced environment. After an initial period of in-office training, this position is eligible for a hybrid-remote work schedule.
Job Responsibilities
- Becomes familiar with and ultimately is the Firm expert on all aspects of new client intake and conflicts clearance.
- Develops and implements Firm-wide best practices in the workflow of new client intake processes and conflicts of interest processes.
- Prepares and ensures compliance with Firm policy of engagement letters and conflict waivers.
- Clears conflicts for new hires, including new employees and partners, as appropriate.
- Clears conflicts for new clients and/or new matters.
- Works closely with Firm General Counsel to resolve risk management and loss prevention issues.
- Conducts legal research on loss prevention issues as needed.
- Works closely with Firm General Counsel to report incidents and claims to the Firm malpractice carrier.
- Determines and issues ethical wall implementation communications.
- In concert with Firm General Counsel, conducts in-house training sessions for Firm attorneys and staff on proper intake and conflict procedures.
- Continues to maintain current knowledge and suggests revisions to and adoption of best practices in loss prevention.
- Clears conflicts for any Firm mergers and/or lateral attorney acquisitions.
- Reviews and analyzes outside counsel guidelines as submitted from clients. Identifies key terms.
- Reviews all external marketing materials for compliance with ethics rules.
- Maintains the accuracy of the conflicts database.
- Coordinates the review and approval of Business Associate Agreements (“BAAs”) and Subcontractor Business Associate Agreements (“SBAAs”) for compliance with HIPAA.
- Works closely with Firm General Counsel to analyze professional liability policies.
Job Requirements
- Must have thorough understanding and appreciation of basic conflicts rules governing the private practice of law.
- Must be familiar with the ethics and conflicts of interest rules of the jurisdictions in which the Firm practices.
- Must have ability to acquire close working knowledge of the guidelines on loss prevention provided by the Firm’s loss prevention insurance carrier.
- Must be technically proficient in the use of relevant technology of the Firm and the Risk Management Department.
- Ability to analyze ethical and professional liability issues and problems and recommend and implement solutions.
- Must be a self-directed, self-starting individual, able to spot opportunities in advance and devise actions to optimize those opportunities.
- Demonstrates excellent interpersonal and communication skills, in order to maintain effective working relationships with partners, attorneys, clients and staff in the discharge of his/her duties.
- Ability to travel as needed.
- Must be flexible and adaptable as an exempt employee to meet the time demands of the position, in circumstances that may sometimes be time-sensitive and urgent.
- Ability to process routine daily functions while being able to resolve sensitive issues and complex assignments utilizing above average critical thinking skills.
- This is a full-time position which requires working a regular basis, as coordinated with the Senior Director of Risk Management. Oftentimes, it may also include working outside of normal business hours to ensure completion of position requirements.
Experience and Education Qualifications
- J.D. degree with 2 or more years of practice experience in a private law firm environment.
- Prior experience with the ethics and conflicts of interest rules is strongly preferred.
- Prior experience with Intapp workflow platforms is strongly preferred.
- Licensed to practice law and member in good standing required.
Compensation
For applicants that meet the experience requirements for the role and are physically based in New York City, the expected salary range is $120,000 – $150,000 annually upon commencement of employment. Starting salary will be determined on an individualized basis with consideration to prior experience and additional qualifications. This is in addition to a comprehensive benefit package offered by the Firm.
