Full-Time Counsel II (Rail Safety)

Job Description

The Department of Public Utilities seeks applicants for the position of Counsel II in the Rail Transit Safety Division.

 

GENERAL STATEMENT OF DUTIES AND RESPONSIBILITIES

The primary purpose of the position of Council II to the Rail Transit Safety Division is to assist the Director of the Rail Transit Safety Division in managing all legal and policy matters affecting the Rail Transit Safety Division. As a hearing officer, the Counsel II participates in and coordinates the work of the technical staff in reviewing cases on which the Counsel II serves as hearing officer, and may supervise other personnel including other Counsel IIs.

DETAILED STATEMENT OF DUTIES AND RESPONSIBILITIES

  1. The primary purpose of the position of Council 2 to the Rail Transit Safety Division is to assist the Director of the Rail Transit Safety Division in managing all legal and policy matters affecting the Rail Transit Safety Division.
  2.  The council 2 to the Rail Transit Safety Division is responsible for managing both adjudicatory and non adjudicatory matters that fall within the scope of Rail Transit Safety matters including but not limited to, regulations, filings requirements with FTA, Corrective Action Plans (CAPs), hazard identification, and enforcement actions In managing legal and policy matters, the AGC must have a working knowledge of Massachusetts General Laws, Federal Transit laws, MBTA policies and procedures, the program plan for the Rail program, as well as many issues on Common Carrier.
  3.  Specifically, the council 2 in the Rail Transit Safety Division will perform the following duties:
  4.  Assist in the formulation of policy concerning rail safety in the Commonwealth;
  5.  Assist in formulating any regulatory or statutory measures that may be necessary to implement policies concerning rail transit safety in the Commonwealth;
  6.  Assist in setting case priorities for the Division;
  7.  Provide final legal review of all decisions before they are released to the public, to the commission, or to federal and state agencies;
  8.  Writing and reviewing briefs and legal memoranda, and participating in negotiations with parties when appropriate.
  9. Manage administrative matters concerning the processing of documents related to case matters and communications from legislators, cities and towns, and consumers;
  10. Coordinate work with other internal divisions related to case-tracking procedures, docketing procedures and the content and management of the Transportation and Rail Transit Safety Divisions section of the website;
  11. Advise the Director of Rail Transit Safety Division and members of the Commission on statutory and procedural requirements for agency action, and on obligations under the Freedom of Information Act, Privacy Act, Public Records Law, Open Meeting Law, and related legislation.
  12. Keep up to date on relevant statutes, regulations, case law, and legal and policy issues relevant to Transportation, Rail Transit Safety, and Department regulations.

QUALIFICATIONS REQUIRED AT HIRE (List knowledges, skills, abilities)

  •        Knowledge of the theory, principles and practices of law including constitutional law.
  •        Knowledge of the procedures followed in courtroom proceedings.
  •        Knowledge of the terminology, symbols and standard abbreviations in legal practice.
  •        Knowledge of the methods of technical and general report writing.
  •        Knowledge of legal research methods and procedures.
  •        Ability to read and interpret legal documents such as decisions, briefs, opinions and contracts.
  •        Ability to exercise discretion in handling confidential information.
  •        Ability to prepare technical and general reports.
  •        Ability to explain the provisions of the laws, rules and regulations governing agency operations and activities.
  •        Ability to analyze and determine the applicability of legal data, to draw conclusions and make appropriate recommendations.
  •        Ability to work independently.
  •        Ability to gather information through questioning and observing individuals and by examining records and documents.
  •        Ability to establish rapport and maintain harmonious working relationships.
  •        Ability to interact with people who are under physical and/or emotional stress.
  •        Ability to deal tactfully with others.

  •        Ability to supervise, including planning and assigning work according to the nature of the job to be accomplished, the capabilities of case team members and/or subordinates and available resources; controlling work through periodic reviews and/or evaluations; motivating case team members and/or subordinates to work effectively.

  •        Knowledge of the state law governing administrative hearings.
  •        Knowledge of sources available for legal research on DPU matters and issues.
  •        Knowledge of the laws and rules governing the presentation and admissibility of evidence.
  •        Knowledge of the laws, rules, regulations, policies, procedures, specifications, standards and guidelines governing DPU operations and activities.
  •        Ability to explain the procedures, guidelines and policies governing DPU operations and activities.
  •        Ability to understand and apply the laws, rules and regulations governing DPU operations and activities.
  •        Knowledge of the principles and practices of records management.
  •        Knowledge of the types and uses of agency forms.
  •        Knowledge of the theory, principles and practices of administrative law.
  •        Knowledge of training methods and techniques.
  •            Knowledge of interviewing techniques.
  •            Knowledge of environmental justice policies, strategies, and best practices.
  •  Knowledge of the principles, practices and techniques of supervision.
