Full-Time Appellate Counsel, Affirmative Litigation

Job Description

Everytown Law seeks a creative, thoughtful, and seasoned appellate litigator to serve as Appellate Counsel.

Everytown Law is part of Everytown for Gun Safety Support Fund, the education, research, and litigation arm of the nation’s leading gun violence prevention organization. We are the largest and most experienced team of impact litigators in the country dedicated to advocating in the courts for gun violence prevention—one of the most pressing issues of our time.

We believe every person has the right to live free from gun violence. It’s our mission to make this belief a reality. We are looking for attorneys who want to use their litigation skills and public-spirited ambitions to join us in advocating on behalf of survivors and others directly affected by gun violence, including marginalized communities. Our clients include students, parents, civil rights organizations, domestic violence coalitions, and cities and counties.

 

Everytown Law engages in two primary areas of litigation:

  1. Affirmative litigation to (a) seek accountability for and reform of the gun industry’s dangerous business practices, (b) take on dangerous gun lobby-backed laws that conflict with constitutional protections, and (c) enforce gun violence prevention laws.
  2. Defense of common-sense, life-saving gun laws against Second Amendment challenges in the wake of the Supreme Court’s recent decision in NYSRPA v. Bruen, under the umbrella of the Everytown Center for the Defense of Gun Safety.

*This position will work primarily on Affirmative Litigation*

 

Recent successes in our affirmative appellate litigation work, both in-house and with partner law firms, include: defending a favorable remand decision in the Seventh Circuit in a case challenging Smith & Wesson’s unfair and deceptive business practices following the deadly July 4, 2023, mass shooting in Highland Park, IL; convincing the Fourth Circuit to affirm a district court’s ruling granting summary judgment to Anne Arundel County, MD, in a case challenging its ordinance requiring local gun shops to provide life-saving suicide-prevention information in its stores; persuading the Texas Supreme Court to deny cert on a petition seeking to reverse a lower court’s decision to allow a suit challenging the negligent and dangerous sales practices of an online ammunition seller to proceed; and, successfully arguing before the Ohio Supreme Court that it should affirm an intermediate court’s decision that a local school district’s policies regarding training armed teachers violated state law.

SCOPE OF WORK AND RESPONSIBILITIES

The Appellate Counsel will have a high level of responsibility and self-direction. The primary responsibilities of the Appellate Counsel will be to work with our Affirmative Litigation team as follows:

  • Drafting and arguing appeals of decisions from our affirmative litigation cases.
  • Drafting amicus briefs on issues pertaining to the work of the Affirmative Litigation team, in trial and appellate courts.
  • Working with outside counsel on appellate briefs, including amicus briefs.
  • Researching, drafting and editing memos relating to appellate issues and recurring or thorny legal issues in the trial courts.
  • Assisting in preparing legal arguments and briefs for cases headed for trial.
  • Assisting in preparing significant legal arguments and briefs in trial-level dispositive motions practice.
  • Working directly with clients, including survivors of gun violence and governmental entities.
  • Working with teams across the organization to advance and defend sensible gun regulation.
  • Participating in some interviewing and supervising of fellows and/or legal interns (depending on experience) and some public speaking, including presentations to law school students and at other public interest events.
  • Participating in team and professional development, including retreats, trainings, and other events.

 

QUALIFICATIONS

  • J.D. and membership in a state bar.
  • 3+ years of overall litigation experience.
  • 2+ years of appellate experience.
  • Demonstrated appellate oral argument experience a significant plus.
  • Clerkship experience a significant plus.
  • Excellent legal analysis, research, writing, and editing skills.
  • Outstanding attention to detail and an ability to explain complex legal concepts to both legal and non-legal audiences.
  • Candidates transitioning from the private sector encouraged to apply.
  • Experience working with marginalized communities and survivors of trauma a plus.
  • A commitment to social justice, an interest in gun violence prevention litigation, and a passion for Everytown’s mission of preventing gun violence in America.
  • Strong interpersonal skills and the ability to collaborate effectively within a team and with other lawyers.
  • Ability to manage multiple projects and staff in a fast-moving environment and to deliver timely and high-quality work.
  • Strong work ethic, sense of humor, flexibility, creativity, and a professional demeanor.
  • Ability to work in a sometimes-hectic, open-plan office.

This is a full-time, hybrid remote/in-office position that can be based in either New York City or Washington, D.C. The salary range for this position is $105,000 to $135,000 per year, depending on experience.
